Banning Triple Talaq? TV actors critique the decision
The
Supreme Court has banned triple talaq, a Muslim Law by which men can divorce
their wives by uttering Talaq three times. Our TV actors give their views on
the judgement.
Sehban
Azim: Triple talaq is in Islam and cannot be amended…but the issue is not the
law. Instead it’s all about how it's been practiced. In a lot of cases, it is
seen that it is being misused. Nowhere in Islamic law does it state that Talaq
is given just by saying it three times, there is a proper procedure that is to
be followed, that takes 6-9 months. During this time, the couple is made to
meet, sit together and rethink their decision. Once that span of time is over,
and if both the individuals are still standing their grounds to get separated
then the only talaq is viable. Until the end of this entire process, there's an
option for the respective husband and wife to withdraw the entire process. So
rather than creating a frenzy or making a hue and cry against Islamic laws or
condemning them, the government needs to educate and spread awareness towards
the right practice of talaq.
Gunjan
Utreja: I welcome this decision of the Supreme Court. Just because something
has been going on for ages doesn't mean it holds true today, too. The
constitution of a country is what binds everything and everyone together and if
something is unconstitutional then it should be gone.
Eijaz
Khan: I think it's a smart and a perfect verdict for now. It's appalling how my
community lacks educated and sensible leadership. I can understand the
apprehensions faced by the older generation of Muslims regarding the decision.
They feel that once anyone else starts meddling with Muslim laws, it will
spread to other laws as well. I think anything that is unfair and discriminates
on the basis of gender should be abolished. Why should there be even a second
thought about it? It’s easy for me to sit here and complain about lack of
educated leadership in my community, but I am hardly doing anything about it.
So I don't think I have a right to complain but I guess eventually we have to
come together to improve things.
Sara
Arfeen Khan: The Supreme Court’s decision by all means is good and will help
those women who have been suffering because of this issue. The Quran has clear
rules for how exactly a divorce should be fairly conducted in various
situations. But since decades, the law of triple talaq has been modified by
religious heads, according to their own convenience. This wasn't in accordance
to the Quran and women had to pay the price. I am proud of this decision.
Angad
Hasija: I support the decision of the Supreme court. Marriage is for keeps and
not breaking on the drop of a hat. It
surely is a positive step. One should understand the system well. I do have
muslim friends and I respect every religion's traditions and customs.
Mohammad
Nazim: I believe more in my religion and than in the Supreme Court. Every
religion has its own customs and beliefs. This idea that you can divorce
someone just by uttering the word ‘Talaaq’ thrice is completely baseless. How
can the Supreme Court interfere in a religion?
It is all politics. Divorce will only take place if you force someone to
get married. A Meher is written at the
time of wedding so security is there after which a Nikaah gets sanctioned. Just by speaking three words divorce doesn’t
happen. There is proper procedure for divorce and it doesn’t happen in instant.
